General terms governing use of the ROMA platform.
These Terms of Service govern your use of ROMA Devices’ websites, online store, ROMA Legion owner portal, product registration tools, digital products, limited releases, preorder/waitlist offerings, and related services.
By using ROMA Devices, creating an account, registering a product, placing an order, downloading content, or interacting with our services, you agree to these Terms. If you do not agree, do not use the services.
“ROMA,” “ROMA Devices,” “we,” “us,” and “our” refer to ROMA Devices, LLC, doing business as ROMA Devices and ROMA Legion.
You may use our services only if you can legally enter into a binding agreement. You are responsible for keeping your account information accurate and secure. ROMA may suspend, restrict, or terminate any account for fraud, abuse, inaccurate information, unauthorized access, resale abuse, policy violations, or conduct that creates risk for ROMA or other users.
ROMA products are small-batch, hand-built, and may vary slightly from photos, descriptions, demo media, finishes, or prior units. Tone, feel, gain response, texture, and performance descriptions are subjective and provided for general product guidance only. ROMA may correct errors, update products, change pricing, limit quantities, discontinue items, or refuse orders at any time.
Placing an order is an offer to buy. ROMA may accept, reject, cancel, refund, or limit any order for inventory issues, pricing errors, payment problems, suspected fraud, shipping restrictions, policy violations, or other legitimate business reasons. All purchases are charged at the full listed price at checkout unless ROMA expressly offers a separate written deposit or payment-plan option. This includes in-stock items, preorders, waitlist items, limited releases, NOS editions, digital products, and special releases. You authorize ROMA and its payment processors to charge the full product price, shipping, taxes, duties, fees, and any other disclosed amounts. Bad-faith chargebacks, payment reversals, or fraudulent disputes may result in order cancellation, account suspension, denial of future purchases, and collection action where permitted by law.
Preorders are treated as paid waitlist or production-queue purchases. A preorder secures your place in ROMA’s fulfillment queue, but does not guarantee a specific ship date unless ROMA states one in writing. Items may ship sooner than estimated if supply, components, or completed inventory become available. Timelines may also change due to parts availability, production volume, testing, quality control, supplier delays, carrier delays, or other operational needs.
Shipping dates and delivery estimates are not guarantees. ROMA is not responsible for delays caused by carriers, customs, weather, supply issues, address errors, failed delivery attempts, or events outside ROMA’s control. You are responsible for providing accurate shipping information. Unless prohibited by law, risk of loss passes to you when ROMA delivers the package to the carrier. International customers are responsible for customs duties, import taxes, VAT, tariffs, brokerage fees, and local delivery charges.
Purchases are governed by ROMA’s Refund Policy and Shipping Policy. Limited releases, NOS items, preorders, waitlist items, custom items, used items, discounted items, opened items, modified items, and digital products may be final sale unless ROMA approves otherwise in writing or applicable law requires otherwise. Unauthorized returns may be refused, returned to sender, or handled at ROMA’s discretion.
ROMA Legion registration tools are provided for ownership records, support, warranty-related workflows, limited access features, and customer convenience. ROMA may require proof of purchase, serial number validation, account verification, or other information before granting or maintaining access. Registration does not expand warranty rights unless ROMA expressly states otherwise in a separate written warranty policy. False registrations, serial abuse, duplicate claims, fraudulent ownership claims, or attempts to access restricted owner benefits may result in removal, account suspension, or denial of service.
Digital products, files, downloads, presets, captures, documents, media, and electronic materials are licensed, not sold, unless ROMA says otherwise in writing. You receive a limited, non-exclusive, non-transferable, revocable license for personal or internal use only. You may not resell, redistribute, sublicense, publicly share, modify, copy, reverse engineer, or commercially exploit ROMA digital content without written permission.
ROMA owns or licenses its names, logos, designs, artwork, product names, trade dress, photos, videos, audio, site content, documents, downloads, software elements, and brand materials. You may not use ROMA intellectual property for commercial purposes, resale listings, advertising, impersonation, product copying, confusingly similar goods, or brand misrepresentation without written permission.
If you send ROMA reviews, photos, videos, comments, suggestions, ideas, or other content, you grant ROMA a worldwide, royalty-free, transferable license to use that content for business, product, support, and marketing purposes. You confirm that you have the right to submit the content and that it does not violate any law or third-party right. ROMA has no obligation to keep unsolicited ideas or feedback confidential.
You may not use ROMA services to commit fraud, violate law, disrupt systems, scrape data, bypass purchase limits, manipulate drops, abuse registrations, misuse serial numbers, impersonate others, upload malicious code, reverse engineer digital content, exploit ROMA assets, or engage in unauthorized resale, bot purchasing, or abusive marketplace behavior.
ROMA may use third-party platforms for payments, shipping, analytics, email, social media, hosting, and other services. ROMA is not responsible for third-party platforms, delays, errors, terms, policies, outages, or business practices.
Except where ROMA provides a separate written warranty, all services, content, digital products, and physical products are provided “as is” and “as available.” To the fullest extent permitted by law, ROMA disclaims all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted service, and error-free operation.
To the fullest extent permitted by law, ROMA will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost business, loss of goodwill, or loss of opportunity. ROMA’s total liability for any claim will not exceed the amount you paid for the specific product or service giving rise to the claim, or $100, whichever is greater.
You agree to defend and hold ROMA harmless from claims, losses, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from your use of the services, violation of these Terms, violation of law, misuse of ROMA content, or infringement of third-party rights.
These Terms are governed by the laws of the State of [State], without regard to conflict-of-law rules. Any dispute must be brought exclusively in the state or federal courts located in [County, State], unless applicable law requires otherwise. ROMA may seek injunctive or equitable relief in any court to protect its intellectual property, systems, brand, confidential information, or business interests.
ROMA may update these Terms at any time. The updated version will be posted with a revised date. Your continued use of the services after changes are posted means you accept the updated Term
